Here’s the part nobody tells you until it goes wrong: when your bags reach a US or EU port, the factory that made them is not the one holding the legal risk. You are. The importer of record is the “responsible party” in the eyes of US Customs, the CPSC, and EU market surveillance — not a workshop in Guangdong or Chengdu. So when a shipment gets detained for a banned chemical, or a California law firm sends a Prop 65 notice, or Amazon pulls a listing for missing a compliance certificate, the invoice lands on your desk.

Who is legally responsible for bag compliance — you or your factory?
In almost every case, the importer is legally responsible, not the overseas factory. A manufacturer in China isn’t the entity placing goods on the US or EU market, so US and EU law puts the compliance burden — testing, documentation, labelling — on the importer of record. Foreign suppliers don’t track your destination market’s rules, and they aren’t liable when a rule is broken.
That single fact reframes the whole sourcing decision. You can’t outsource compliance by assuming “the factory handles it.” What you can do is choose a factory that builds to the right limits and gives you the paperwork to prove it — and write that expectation into the order. Which US rules actually apply to custom bags?
Most adult bags have no mandatory federal pre-market test — but three US regimes still reach them, and two of them carry real teeth. Here’s the short version before the table:
- CPSIA only bites if the bag is a children’s product (designed or intended primarily for users 12 and under — think kids’ backpacks, character totes).
- California Proposition 65 applies to almost any consumer product sold into California by a business with 10+ employees.
- California AB 1817 bans PFAS in textile bags sold in California, in force since January 2025.

Two things buyers routinely miss. First, “no federal test required” is not the same as “safe to sell” — Prop 65 and AB 1817 both apply to ordinary adult bags, and both are enforced by private litigants who get paid to find violations. Second, US Customs can detain a shipment for reasons beyond chemistry — forced-labor rules (UFLPA) mean cotton or other materials of unverified origin can be held at the border. Knowing your material origin is part of compliance, not a separate issue.
Which EU and UK rules apply to bags?
In the EU and UK, the main chemical rulebook for bags is REACH — specifically Annex XVII, which sets hard limits on substances in articles that touch the skin. Unlike the US, these are numeric limits that apply to ordinary adult bags, not just children’s products, and the importer is again the “producer” expected to have tested for compliance.

Beyond REACH, the EU’s General Product Safety Regulation (GPSR), in force since December 2024, requires an EU-based “responsible person” and a basic safety file for consumer goods sold in the EU — a logistical requirement importers often overlook until a marketplace asks for it. Coated “waterproof” fabrics and chrome-tanned leather are the two components most likely to fail, because PFAS and chromium VI are exactly what buyers don’t think to ask about. What documents actually prove a bag is compliant?
Compliance is proven by test reports and the right certificate — not by a supplier saying “yes, it’s compliant.” Verbal assurance is worthless at a port. Here’s what each document is and when you need it:
- Third-party lab test report (from an accredited lab such as SGS, Bureau Veritas, Intertek, TÜV, or Eurofins). This is the actual evidence — it names the substance, the method, and the measured result against the limit. Everything else references this.
- Children’s Product Certificate (CPC) — legally required for children’s products, and it must be based on CPSC-accepted third-party testing.
- General Certificate of Conformity (GCC) — for general-use products subject to a specific CPSC rule. Most adult bags aren’t subject to one, so a GCC often isn’t legally required — but retailers and Amazon frequently ask for test reports regardless.
- AB 1817 certificate of compliance — a manufacturer statement that a textile bag contains no regulated PFAS, required to sell into California.
- EU: technical file + GPSR responsible person — plus REACH test reports for the restricted substances above.
A blunt reality check: a report is only meaningful if the lab pulled the sample and the bulk uses the same materials that were tested. A clean report on a hand-picked sample means nothing if the factory swaps to a cheaper non-compliant coating for the production run. Which brings us to the part you can actually control.
What should you demand from your manufacturer before ordering?
Before you pay a deposit, get four things in writing: which limits they’ll build to, recent test reports for your materials, material traceability from sample to bulk, and who arranges and pays for lab testing. This is where compliance is won or lost — long before the goods ship.
A short checklist to send with your RFQ:
- Name your markets and limits. “This ships to the US (California) and the EU” tells a serious factory to avoid PFAS coatings, chrome-tanned leather with high Cr VI, and non-compliant azo dyes from the start. Vague briefs get vague materials.
- Ask for recent third-party reports on the same materials — not a generic certificate, but a report showing Cr VI, azo, PFAS, phthalate, and lead results for the fabric, leather, or hardware you’re actually using.
- Require material traceability so bulk matches the tested sample. This is the single biggest failure point: the tested sample is clean, then bulk quietly substitutes a cheaper coating or dye. Ask how they lock materials and inspect for substitution.
- Agree who arranges the lab booking, pulls samples, and pays. Get it in the proforma invoice, not a WeChat message.

Do non-children’s bags actually need lab testing?
Federally, most adult bags aren’t subject to mandatory pre-market testing. But California’s Prop 65 and AB 1817 apply to ordinary adult bags, and most serious retailers and marketplaces (Amazon included) require test reports before they’ll list you. In practice, testing is effectively necessary if you’re selling through real channels — it’s just enforced by lawsuits and retailer requirements rather than a customs checkpoint.
Who is legally liable if my bags fail compliance?
The importer of record — you. The overseas factory isn’t placing the goods on the US or EU market, so the
legal responsibility for testing, certificates, and labelling sits with the importer.
Is a Prop 65 warning label enough?
No. A warning manages Prop 65 exposure risk, but it does nothing for AB 1817 PFAS compliance or EU REACH limits — those are outright restrictions, not warning-based. And reflexive “over-warning” carries its own litigation risk in California. Treat the warning as one tool, not a blanket solution.
How much does bag compliance testing cost?
Labs price by scope, so it depends on how many substances and materials you test. A single chemical panel
on one material is usually in the low hundreds of US dollars; a full multi-material, multi-market scope runs higher. Get a quote for your exact bill of materials and destination markets rather than a flat figure.
Does “Made in China” affect whether a bag is compliant?
No. Compliance is about the product’s chemistry and your test documentation, not the country on the label
— a bag made anywhere can pass or fail the same limits. What matters is whether the factory builds to your market’s limits and can prove it.
